Federal Judge Temporarily Blocks President Trump’s Efforts to Cut Planned Parenthood Funding
A federal judge has temporarily blocked a portion of President Trump's "Big Beautiful Bill" that reduces Medicaid funding for Planned Parenthood. The decision came just hours after the abortion provider filed a lawsuit to defend its federal financing.
The defunding proposal was put on hold on Monday when U.S. District Judge Indira Talwani issued a 14-day Temporary Restraining Order. Despite not naming Planned Parenthood, the complaint contends that the bill's framework effectively singles the organization out by imposing requirements that only they can comply with. According to Planned Parenthood, about 200 of its clinics may have to close as a result of the funding reduction.
The Trump administration's attempt to cut Medicaid funding to Planned Parenthood was temporarily blocked by a federal judge on Monday, blocking a key component of the president's signature legislative package, the "Big Beautiful Bill." The decision was made just hours after Planned Parenthood filed a lawsuit in the Massachusetts U.S. District Court.
Former President Barack Obama selected Judge Indira Talwani, who issued a Temporary Restraining Order prohibiting the Department of Health and Human Services from carrying out the defunding action for a period of 14 days. “Take all necessary steps to ensure that Medicaid funding continues to be disbursed” to Planned Parenthood during that time, Talwani said in her order.
Even though Planned Parenthood isn't named in the law expressly, it is the de facto target because it is the only abortion provider that fits the measure's requirements. The legal team for Planned Parenthood argues that the clause is unlawful and discriminatory. The lawsuit claims that "a large number of Planned Parenthood members may be forced to close a significant number of their health centers nationwide, many of which are in rural or underserved areas... Members will be required to lay off staff and curtail services."
Under reconciliation rules, Senate Republicans were able to approve the package with a simple majority instead of the usual 60 votes because it included a one-year Medicaid funding cutoff.
Pro-life lawmakers have maintained that any financing to groups that perform abortions indirectly supports the operation, even though the Hyde Amendment already prohibits federal funds from being used directly for abortions—with few exceptions. In a statement cited by CBS News, Planned Parenthood expressed their gratitude that the court moved quickly to stop the unconstitutional statute that targeted their patients and doctors.
The White House aggressively retaliated. According to a White House official who spoke to CBS, "The Trump Administration is ending the forced use of Federal taxpayer dollars to fund or promote elective abortion—a commonsense position that the overwhelming majority of Americans agree with."
Conservative MPs condemned the judge's action. Senator Mike Lee of Utah said, "Unless I'm missing something, this is an abuse of judicial power." Additionally, I believe the House Judiciary Committee will examine articles of impeachment unless there is more to the tale.
"An unelected judge has no authority to override the will of 77 MILLION Americans who voted to defund Planned Parenthood," wrote Illinois Congresswoman Mary Miller, who also criticized the ruling. The last time I looked, the Constitution grants control of the purse to Congress, not to activist judges. We must put an end to this misuse of authority.
